TevfikArif’s Doyen’s Case in the Spotlight of the Football World – Who Is in Charge of Sports-Related Legal Cases?\r\nThe Brussels Court of Appeal made a huge decision in favor of TevfikArif’s Doyen Sports Investments fund. Doyen Group is an agency that has spread across entire Europe and works closely with many players and soccer clubs. Their services include offering financial advisory, as well as handling careers of the players the best as possible. \r\nThe company is based in London and serves players and clubs from the entire world. In fact, they were a part of hundreds of reputable transfers, which is the reason they are now recognized as one of the best in business. \r\nThe latest decision also raised the reputation of the company. After all, they decided to challenge some of the biggest international organizations and they succeeded in securing a positive outcome. An official statement wasn’t issued by TevfikArif or anyone else from the company yet.\r\nWhat Happened?\r\nEverything started in 2015 when RFC Seraing from Belgium together with Doyen Group decided to file a lawsuit against sports institutions. FIFA had banned investment funds from owning the rights to players, but the claimants decided to challenge the decision in an effort to reverse the ban. They also used the opportunity to appeal against some other decisions made by UEFA and FIFA. \r\nThe Belgian court first refused the request of FIFA to move the matter to Zurich and then ruled against them and other organization. This happened at the end of August and the repercussions of this decision could be huge.\r\nFrom now on, every sports-related legal matter should be handled by domestic courts. As a result, both clubs and players can theoretically challenge FIFA, UEFA, or other organizations in domestic courts. \r\nCAS – the Court of Arbitration located in Lausanne and acknowledged by FIFA,hasreacted to the decision, emphasizing that the Belgian court doesn’t have a jurisdiction over the matter, which is their way of challenging this ruling. The Brussels Court of Appeal quickly revealed that the objection about jurisdiction was rejected and that the Belgian law doesn’t provide the ground for an exception that would make a domestic court excepted in this case.\r\nIt seems that FIFA hasn’t detailed the matters enough in their Statute and that is how the Belgian Court can have jurisdiction over the matter. The problem that arises is that the court hasn’t pronounced CAS’s decisions so far illegal. \r\nAll this implies that any case in the future may have two different decisions – one made by a domestic court and applicable only in that country, and the other one made by CAS which will be applicable in the rest of the world. \r\nAlthough we are still waiting for the Brussels Court of Appeal to react to CAS claims, there is no doubt that this case is huge. We could very soon have a completely different situation regarding how clubs and players do business and legal matters. \r\nCAS seems like they are ready to fight but TevfikArif and Doyen undoubtedly have a great time of lawyers, so stay tuned for all news regarding this case.
